Migrant family separations: All kids under 5 to be reunited by today

"It's extremely disappointing that the Trump administration looks like it will fail to reunite even half the children under 5 with their parent", said ACLU attorney Lee Gelernt.

The judge has acknowledged in court Tuesday that after further investigation some parents may not fall within the class of those eligible for reunification with children at this point, but he reiterated to the Justice Department that the timetables he had ordered for reunifying families were "firm deadlines, not aspirational goals".

The government said 24 children are now not eligible to be reunited with parents "due to circumstances of the adults in question", 11 of whom are in criminal custody with either the U.S. Marshals Service or state jails.

The government missed a federal judge's initial deadline of Tuesday to have all children under 5 reunited with parents.

The administration faces a second, bigger deadline - July 26 - to reunite perhaps 2,000 or so older children with their families.

Sarah Fabian, a Justice Department lawyer, said that as of this weekend, there were 102 children under five who were still in government custody and separated from their parents. "They told me I could buy more in the commissary".

Officials said they are searching for sponsors for children whose parents are ineligible to take custody of them, including another parent, relatives or a legal guardian in the United States.

Catholic Charities, which helped place some of the children in shelter facilities after their separation, held a news briefing in NY at which a handful of the reunited parents expressed relief after weeks of anxiety over the separations.

President Donald Trump responded by signing an executive order to keep migrant families together after they cross the U.S. -Mexico border.

If in fact 57 children have been reunited because of the lawsuit, we could not be more happy for those families.

In New York, Javier Garrido Martinez spoke through tears Wednesday as he held his 4-year-old son, who fed a Dorito to his father as he sat on his lap.

"To me, the overwhelming feeling was this is right that they're being reunited, but this was so wrong from the very beginning, and it didn't have to happen this way", Bellor said.

Abril Valdez of the ACLU of MI said the government was "vague" on the time and place of the reunifications that could come on Tuesday (Wednesday NZT) for two Honduran men he represents.

Parents were taken into criminal custody and then held in immigration detention centers, deported or released in the United States.

Seven adults were determined not to be the child's parent and 12 parents had already been deported.

'Judges run the system and illegals and traffickers know how it works. Several parents have already been deported, while authorities disqualified others due to criminal records. The bleeding still did not stop: "They were refusing to give me sanitary towels, I needed like 30 per day and we were given three per day", said Pagoada.

On Tuesday, Justice Department lawyers told Sabraw they would reunite 38 children by the deadline.

Sabraw agreed that not all 103 children could be reunited and that certain cases are too complicated to complete within his deadlines.

The government has indicated that it will take steps to streamline reunifications, which have to be completed before the month ends.

HHS said 46 other children were not eligible for reunification.

A spokesperson for U.S. Immigration and Customs Enforcement said in an email to CBS News that the child's parent is not now in ICE custody.
