  • Apple and Samsung back in court over seven-year patent feud

In late 2016, the US Supreme Court agreed with Samsung and ordered the two tech giants to negotiate a date for a retrial to settle the award money for Apple, the The Korea Herald report said.

The legal battle has been raging for seven years now, after Apple first sued Samsung for copying its iPhone designs in 2011.

Jurors at the retrial before US District Judge Lucy Koh in San Jose, California, learned at the outset that the South Korean company infringed three of Apple's design patents and two utility patents. Determining the outcome won't be easy for the jury, McKenna says. Samsung's lawyers appealed the case, bringing down the compensation of $1 billion to $400 million in 2015 at the US Court of Appeals for the Federal Circuit. Meanwhile Samsung's lawyer Kathleen Sullivan told the justices, "A smartphone is smart because it contains hundreds of thousands of the technologies that make it work".

For his part, Joswiak today opened by saying that Steve Jobs built Apple around a central theme of design while showing the jury photos of Apple products. Neither Apple CEO Tim Cook nor the company's design chief Jony Ive is expected to testify.
