Apple Ordered to Pay $502 Million in VirnetX Patent Battle Loss

A federal jury rules that Apple (NASDAQ:AAPL) has to pay VirnetX (NYSEMKT:VHC) $502.6M due to patent infringement.

VirnetX claimed that Apple's FaceTime, VPN on Demand and iMessage features infringe four patents related to secure communications, claims that Apple denied. The legal battle has been protracted, and it involves multiple lawsuits and a dizzying number of appeals.

Since 2010, Apple has been in a patent fight with Internet security software company VirnetX.

If this feels familiar, it's because we've been here before, and Apple isn't VirnetX's only target. The case isn't dead yet though, the United States legal system has plenty of room for additional appeals and Apple is exploring those options already. The case seemed to have been filed again in 2012 and was won by the patent troll, after which Apple had to pay almost United States dollars 368 million.

This seems like a massive victory for VirnetX, and indeed it would be if Apple is ultimately forced to pay even a portion of the damages awarded in the case. In cases that are before the U.S. Court of Appeals for the Federal Circuit, the Patent Trial and Appeal Board (USPTO) has already made the determination that the patents in question are invalid.

Apple has denied that its devices violate VirnetX patents and has battled previous losses.

In 2017 however, Apple filed an appeal against the US district court verdict, though it lost the case.

In a statement to Bloomberg, VirnetX CEO Kendall Larsen called the damages amount "fair". Six months before the previously mentioned 2016 verdict, the firm helped VirnetX win a USD625.6 million award against Apple in another Eastern District case.
