Jack Junior Montgomery, 31, faces a felony first-degree murder charge in connection with the death of 6-year-old Brice Russell.

As investigators began questioning Brice's siblings in the room, they learned they were forced to sleep in the same bed as their brother's body all night, reported WFLA. Jack Junior Montgomery, 31, has been charged with first degree felony murder and three counts of aggravated child abuse.

The boy's brothers told investigators that they were forced to watch Montgomery hit him and were threatened with violence if they did not join him. Police arrived at the hotel and spoke with a man who identified himself as "Jack" and claimed that the noise was him loudly playing his music.

A Florida man is facing murder charges for allegedly killing his 6-year-old stepson by throwing him against a wall-then forcing the boy's young brothers to sleep in bed with his body.

It was the second time in less than 24 hours that deputies were called to Montgomery's hotel room, according to the Herald. Under imminent fear of being hurt by Montgomery, one child did strike Brice. Crews pronounced him dead at 10:59 a.m., according to WFTS.

The step father told authorities he threw Brice onto the bed after he caught the boy sneaking out of bed to get a cookie.

A sheriff's department affidavit said that deputies had been called to the hotel earlier in the morning on Saturday after a guest in another room reported what sounded like Mr. Montgomery yelling "beat the kid" and "push the kid over here". They saw blood running out of the child's nose and mouth, and said their brother never woke up after that.

Finally, the children said Montgomery picked up Brice by his leg and threw him against a shelf along the wall. "Repeatedly punching and throwing him on the ground".

Detectives wrote that the children described Montgomery putting water on the boy's face and slapping it in an effort to awaken him.

The Medical Examiner's Office determined the victim's death a result of homicidal violence. He opened the door so the deputy could see the children lying in bed, after which the officer left without further investigation.

Hillsborough County Sheriff's Office deputies wrote in an arrest warrant for Montgomery that he and four children were staying in an extended stay hotel room in Seffner, Florida, around midnight on December 30, when a guest in a neighboring room told a hotel manager she heard loud yelling coming from Montgomery's room. He is now being being held on $870,000 bond.
