CJI Dipak Misra selectively assigned political cases: Prashant Bhushan

  • Government sources said the Supreme Court should settle the issue at the earliest as the faith of the people in the judiciary was at stake

It has maligned the image of judiciary in public. So it was nothing short of astounding that the highest in the judiciary should come to the court of the media to seek redress.

"All our efforts have failed and we are all convinced that unless this institution is not preserved, democracy can't be protected in the country", he added.

The exclusion of CJI Dipak Misra from the Press meet dropped hints that the conference may be targeted against him.

"There are many wise men saying many wise things in this country".

When the media asked whether this letter and their decision to address them for the first time in independent India's history was in regard to the Justice Loya case, Justice Chelameswar consulted with Justice Gogoi, and then said, "We are making a copy of the letter available to the press".

In their letter to the CJI, the judges record their displeasure over the October 27, 2017, order of a two-judge bench in R P Luthra vs Union of India. What was in the note, they wouldn't say.

On Friday, Justice Gogoi told journalists that the unprecedented press conference was prompted by the death of trial court Judge Brijgopal Harkishan Loya.

Three are scheduled to retire this year, while Gogoi is in line to be the next chief justice, based on seniority. It comprised just one word.

The clash among the judges in the highest court also comes in the wake of a controversial order in November in which justice Misra declared that the chief justice "is the master of the roster" having exclusive power to decide which case will go to which judge.

The matter is now in the public, and while the media trials are not allowed, the judges have submitted yet the entire judiciary to the trial by the media.

The government did not wish to be seen as "interfering" in any manner on a sensitive matter concerning the judiciary, which could be misconstrued by either of the sides. If so which are these specific instances? The judges thanked the journalists for arriving at a short notice, before speaking their heart out without any prepared text or document. How will Friday's events impact future collegium meetings?

In 2011, the Rajya Sabha had found Calcutta HC judge Justice Soumitra Sen guilty of financial misappropriation as a judge and of misrepresenting facts, which had led to the Upper House to vote in favour of his impeachment. However, the government has not taken any stand over the dispute between judges and CJI. "Our judiciary is reputed all over the world, independent and they will sort the matter themselves", said minister of state for law P P Chaudhury. Their strategy may well be Maun Ki Baat. More than ever before we need to shed a light on the killings of Sohrabuddin, Kauser Bi and Tulsi Prajapati being heard in Mumbai.

"Politics by political parties of the country, outside the judicial purview, trying to drag issues which are internal to the judiciary and politicise that is something which should not be attempted", BJP spokesperson Sambit Patra said".

█ █ What has happened today could have been avoided. The four judges seemed a tad uncomfortable at the barrage of questions from journalists.
